中华人民共和国对外经济贸易部关于纺织品出口配额的管理办法(附英文) 1992年12月31日,对外经贸部 第一章 总 则 第一条:为了履行中国政府与纺织品进口设限国家政府签定的双边纺织品贸易协议,有效地管理纺织品配额,有秩序地发展对这些国家的纺织品出口,特制定本办法。 第二条: 1、中华人民共和国对外经济贸易部(以下简称“经贸部”)统一领导对设限国家的纺织品出口管理工作。对外负责谈判协议,协商解决双边协议执行过程中出现的问题;对内负责纺织品出口配额的分配、调剂、监督使用和管理,授权纺织品出口证书的签发部门,统一管理全国证书的发放和统计。 2、各省、自治区、直辖市及计划单列市经贸厅(委)、外贸局(以下简称各地经贸委)为本地区对设限国家出口纺织品的行政管理部门。负责根据经贸部的授权签发纺织品出口证书;按经贸部规定组织本地区范围内的纺织品配额的余缺调剂;管理和督促检查本地区出口企业所分得配额的使用并负责本地区对设限国家纺织品的出口统计工作。 3、海关总署及各地海关对所有输往设限国家协议项下的纺织品实行监管,凭有效的纺织品出口证书查验放行货物。 对设限国家协议项下纺织品品类(包括配额品类和非配额品类)见附件一。 第三条:本办法所称设限国家,为与中国签定双边纺织品协议的美国、欧共体、加拿大、芬兰、挪>和奥地利。 第四条:本办法所称纺织品配额,系指双边协议项下棉、毛、人造纤维、其他植物纤维和丝混纺纺织品及其制品的出口数量的限额。纺织品分类和配额计量单位以双边协议规定为准。 第二章 出口许可制度 第五条:对设限国家出口纺织品实行纺织品配额和出口许可证管理制度。配额由经贸部按本办法有关规定进行分配;出口许可证由经贸部配额许可证事务局和各地授权签证部门按经贸部分配的配额签发。 第六条:有纺织品出口经营权并承担上缴国家出口创汇任务的企业方可申请其经营范围内的纺织品配额。 第七条:已获配额的出口企业在每批货物出运前凭合同正本或副本,商业发票,国内生产加工证明以及信用证或本票向签证部门申领出口许可证或其他证书。出口许可证正本交进口商凭以清关提货或向其政府主管当局申请进口许可证。出口许可证副本一联(海关查验放行联)交海关查验放行,另一联经海关核验后退主管发证当局。 第八条:各种出口证书均应严格按照经贸部编制的《填制说明》用打字机或微型计算机填制。证书一经签发,持证企业不得自行涂改。证书种类见附件。 第九条:签证日期应尽量接近货物的实际出运日期,许可证所列年度应与货物出运年度相一致。各种证书的有效期为三个月,签证一般为三个工作日。 第十条:纺织品出口签证按国家有关规定收取签证费。签证费用于与本项工作有关的开支,不得挪用。 第三章 配额的分配 第十一条:分配原则 为稳定市场、增加创汇和有效管理,配额分配应相对集中,不宜过散;配额基本上分配给有纺织品出口经营权,承担上缴国家出口创汇任务并有对设限类别出口实绩的出口企业;分配多少配额,按其上年出口实绩多少、售价高低和对纺织品出口的贡献大小以及执行本办法有关奖惩规定而定。 第十二条:分配方式 1、基础配额的分配 基础配额分配每年分预分和决分两次进行。上年九月进行预分,当年三月进行决分。 (1)基础配额的预分 1)于每年九月预分下年度配额。凡持有基础配额的出口企业在当年度一至八月实际使用基础配额达到60%以上的,按基础配额的80%预分下年度配额。实际使用基础配额少于60%的,原则上按实际使用基础配额数预分下年度配额。 2)配额预分计算公式为: a、当年一至八月实际使用基础配额达到60%以上的,可预分基础配额的80%: 基础配额×80%=下年预分配额数 b、当年一至八月实际使用配额基数未达到60%的: 配额基数×实际配额使用率=下年预分配额数 (2)基础配额的决分 1)凡持有基础配额的出口企业,在正常贸易条件下,配额使用率在90%以上者,可获得上年基础配额的100%;使用率低于90%的,按其实际使用率分配。如使用率低于90%,但在当年七月十五日前上交未用数的,可获得上年基础配额的100%;如连续两年未使用完所分得的配额,即使按规定的时间上交,也要适当减少其第三年度配额。如在八月至九月交回当年剩余配额,下年配额扣罚交回部分的25%;十月至十一月交回的,扣罚交回部分的50%;十二月一日以后交回或不交回的,扣罚交回或不交回的全部。如连续两年不交回当年剩余配额或浪费配额情况严重,按未使用部分加倍扣罚。 2)配额决分计算公式为: a、上年配额使用率在90%以上(包括在七月十五日前交回剩余配额): 上年基础配额×100%=当年基础配额 b、上年配额使用率在90%以下,剩余配额在八至九月交回,扣罚交回部分的25%: 上年基础配额-交回配额×25%=当年基础配额 c、上年配额使用率在90%以下,剩余配额在十至十一月交回,扣罚交回部分的50%: 上年基础配额-交回配额×50%=当年基础配额 d、上年配额使用率在90%以下,剩余配额在十二月一日以后交回或不交回,扣罚交回或不交回配额的全部: 上年基础配额-交回或不交回配额=当年基础配额 2、年增率配额的分配 (1)年增率配额由经贸部按各省、自治区、直辖市、计划单列市及国家有关部门的出口企业纺织品出口的贡献大小进行分配,其中各省、市、自治区、计划单列市的配额切块分配到各地经贸委,各地经贸委将所分得的配额根据经贸部的规定对本地区的有关出口企业按纺织品出口的贡献大小提出分配意见报经贸部核准后按基础配额在决分时一并下达。国家有关部门的出口企业配额由经贸部按有关企业纺织品出口贡献大小在决分时直接分配。 (2)纺织品出口的贡献大小,系指各省、自治区、直辖市、计划单列市及国家有关部门出口企业上年纺织品出口总值所占全国纺织品出口总值的比重。 (3)年增率配额分配计算公式为: a、全国纺织品出口总值 ——————————=每标准配额平均创汇金额 年增率标准配额数 b、XX省纺织品出口总值 ——————————=XX省年增率配额数 每标准配额平均创汇金额 3、其他灵活配额的分配 其他灵活配额系指使用协议部分灵活条款(上年结转和当年类别转移部分)所提供的配额和执行本办法有关奖惩条款所扣罚的配额以及各地上交经贸部的配额。 (1)上年结转和当年类别转移部分配额的分配: a、一部分由经贸部按本办法第三章第十一条在配额决分时择优分配,一并下达。 b、另一部分按本办法第四章第十四条执行。 (2)扣罚所得的配额先用于补偿受损失的出口企业,如有剩余按本办法第六章第十七条分配。 (3)各地上交配额按本办法第四章第十四条执行。 4、配额的招标 (1)为鼓励发展高档>装产品的出口,提高配额使用的经济效益并给符合条件的出口企业提供竞争机会,经贸部每年安排部分配额进行招标。 (2)配额招标由招标工作委员会(由经贸部对外贸易管理司、中国纺织品进出口商会组成)具体负责。 (3)配额招标按经贸部制定的配额招标办法执行。 第四章 配额的转让和调剂 第十三条:配额的转让 1、持有基础配额的出口企业可在本地区内自行协商进行配额转让,但须当地经贸委批准并报经贸部备案下达配额转让通知后方可执行。 2、持有基础配额的出口企业可跨地区自行协商进行配额转让,但须通过配额转出企业所在的当地经贸委批准报经贸部备案下达配额转让通知后方可执行。 3、转出的配额必须是各出口企业的基础配额,转出的比例最高为有关类别的20%,如转出数量超过20%,则在分配下年配额时扣减所超百分比的数量,如连续两年转出同一类别的配额,则在分配第三年配额时予以适当扣减。 4、配额的转让应在持有基础配额的出口企业间进行。如需转至有纺织品出口经营权并承担上缴国家出口创汇任务但无基础配额的出口企业,须通过配额转出企业所在的当地经贸委同意报经贸部批准下达配额转让通知后方可执行。 5、配额转入者不得将转入的配额再次进行转出。 第十四条:配额的调剂 1、各地经贸委可根据本地区出口企业的配额使用情况组织持有配额的出口企业间的纺织品配额余缺调剂,但须报经贸部备案后下达配额调剂通知方可执行。 如需调至有纺织品出口经营权并承担上缴国家出口创汇任务但无配额的出口企业,须报经贸部批准后方可执行。 2、经贸部可视具体情况于下半年组织全国范围内的纺织品配额余缺调剂。 (1)调剂配额的来源,主要是各地方经贸委上交的剩余配额和使用协议部分灵活条款(部分上年结转和当年类别转移部分)所提供的配额。 (2)配额调剂按本办法第六章第十七条执行。 (3)配额调剂相对集中进行,公开透明。 (4)配额调剂申请应通过各地经贸委向经贸部提出,经贸部一般不受理地方出口企业直接提出的配额调剂申请。 第五章 配额的计算和统计 第十五条:对各协议国家,配额均以日历年度计算。 第十六条:纺织品出口证书的统计工作按经贸部制定的《对纺织品设限国家发放出口证书进行电脑跟踪统计的施行办法》执行。 第六章 奖 惩 第十七条:对严格执行本管理办法和出口实绩达到分得配额95%以上的出口企业,只要符合下列条件者,则给予一定额度的奖励: 1、发展高档产品出口成绩显著,售价水平高; 2、带动非配额产品出口贡献大; 3、使用国产面料高于同类企业。 第十八条:对于下列情况则给予处罚: 1、对不按本办法规定上交剩余配额的,按第三章第十二条进行扣罚。 2、对擅自超用配额的出口企业和超配额发证的签证机构,将按多占配额如数扣罚或加倍扣罚出口企业下年配额并通报批评签证机构。对严重超配额发证的签证机构,将吊销发证权。 3、对售价过低的出口企业,将酌情减少其有关类别的下年配额。 4、对只发空证而不实际出口货物的舞弊行为将加倍扣罚出口企业下年配额。 5、对违反进口国原产地规定,非法利用第三国/地区产地证或标签转口我国纺织品至设限国家的出口企业,视其情节轻重扣罚或加倍扣罚有关出口企业或地区的配额或没收货物、处以罚款,直至追究法律。 6、因管理不善丢失空白许可证而占用我国配额者,加倍扣罚下年配额。 7、对私自更改,伪造纺织品证书者,依法从严惩处包括交由司法机关追究法律。 8、对违反本办法的有关规定而出口的货物,海关可根据情况作出罚款或没收货物的处理。 第十九条:奖励配额的来源,为扣罚配额和使用部分灵活条款所提供的配额。但扣罚配额先用于补偿被占用配额的出口企业。 第二十条:出口企业获得的奖励配额将不作为下年配额的基数。 第七章 附 则 第二十一条:纺织品配额管理的各项工作应严格执行本办法,防止主观随意性。经贸部和各地经贸委的管理工作人员应接受监督,如有以权谋私、违反本办法者,经调查核定后,将视情节轻重给予处分直至追究刑事。 第二十二条:各地经贸委和各出口企业均应安排足够的人员专司此项工作,管理人员要相对稳定。 第二十三条:各地经贸委应根据本办法,结合本地区具体情况,制定实施细则,并报经贸部备案。 Administration of the TextileExport Quota (Promulgated by the Ministry of Foreign Economic Relations andTrade of the People's Republic of China on December 31, 1992) Whole Doc. Chapter 1 General RulesArticle 1 The present Provisions are formulated for the purpose of implementingthe bilateral agreements on trade in textile products concluded betweenthe Government of the People's Republic of China and the governments oftextile importing countries applying quantitative restrictions, andkeeping effective administration on textile quotas to develop the exportsof textile products to these countries in an orderly ticle 2 (1) The Ministry of Foreign Economic Relations and Trade of thePeople's Republic of China (hereinafter referred to as MOFERT) has thecentralized authority of the overall administrations of exports of textileproducts to the restricting countries. MOFERT is responsible, externally,for negotiations of the bilateral agreements and consultations withimporting countries to settle the problem in the course of implementingthe agreements, and internally responsible for the administration,allocation, adjustment and supervision of the utilization of the textileexport quotas. It also confers the issuing authorizations to thelocalities and departments concerned for issuing the export certificatesof textile products, and supervises a unified controlling on thecertificates and their statistics. (2) The Commissions (Departments) of Foreign Economic Relations andTrade, or the Foreign Trade Bureaus in all the provinces, autonomousregions, municipalities directly under the Central Government and thecities with separate plannings (hereinafter referred to as the localauthorities) are the administrative organizations which supervise theexports in their own areas of textile products to the restrictingcountries. As authorised by MOFERT. their responsibilities include:issuing the export certificates, coordinating the transfer of the textilequotas between enterprises of the same area, administering and supervisingthe quota utilization of their enterprises, and reporting to MOFERT thestatistical information of their textile exports to the restrictingcountries. (3) The General Administration of Chinese Customs and its subordinateOffices throughout the country shall supervise and control all the exportsof textile products destined to the restricting countries. Every shipmentshall be verified and released upon the presentation of valid exportcertificates. Categories of textile products (both for quotas and non- quota items)classified by restricting countries are listed in Annex I to ticle 3 The restricting countries referred in the Provisions are thecountries that have concluded with China the bilateral agreements on tradein textile products. They are the United States of America, the EuropeanEconomic Community, Canada, Finland, Norway and ticle 4 The textile quota refereed in the Provisions means are thequantitative limits for export of textile and finished products made ofcotton, wool, man-made fibers, vegetable fibers other than cotton and silkblends under the bilateral agreements, classifications and units of quotaare specified by the agreements. Chapter 2 Export License SystemArticle 5 Exports of textile products to the restricting countries are subjectto controlling systems of textile quotas and export license. Textilequotas are allocated by MOFERT in compliance with the relevant provisionsof the Provisions; Export Licenses are issued by the Quota and LicenseIssuing Department under MOFERT and local issuing authorities delegated byMOFERT according to the quantities of MOFERT ticle 6 Only the enterprises, which are entitled by the State to handle thetextile export businesses and committed to hand over foreign exchangeearnings to the government, can apply for the quotas that cover theproducts falling into the scope of their ticle 7 Before actual shipment, enterprises which have been allocated withquotas shall apply to their local issuing authorities for Export Licenseand other certificates, by presenting the original or copy of salescontract, commercial invoice, certificates of domestic production orprocessing, Letter of Credit or cashier's cheque. The original of theExport License is delivered to the importer, who shall, by presenting theoriginal, apply for the Customs clearance of the goods or for importpermissions with their authorities. Two copies (Customs supervision) aresubmitted to Chinese Customs, one is for Customs file and the other shallbe returned to the issuing authorities after it is checked and sealed bythe ticle 8 All the export certificates shall be filled up with typewriter orcomputer in strict accordance with "The Explanatory Notes On CertificateDeclaration" compiled by MOFERT. Once they are issued, the certificatescan not be amended by the holder. The types of the certificates are listedin the Anuex ticle 9 The issuing date in the certificates shall be as close to the actualdate of shipment as possible, and the quota year shown in the certificatesshall be the calendar year in which the goods are shipped. All thecertificates are valid for 3 months after the day of issuing. In normalcase, it takes no more than 3 working days to get a certificate ticle 10 Certificates are issued with cost charges according to the relevantregulations of the State. All the incomes shall be spent on the relatedfields of textile quota administration. Chapter 3 Quota AllocationArticle 11 Principles of Allocation In order to stabilize the market and increase foreign exchangeearnings, and for the purpose of more effective controlling, theallocation of quota shall be relatively concentrated rather than widelydispersed. Quota should mainly be allocated to the enterprises which havethe government permission to handle textile export business, undertake tosubmit foreign exchange earnings to the State, and meanwhile have had pastperformance of exporting the products prior to restriction. The quantitiesof quota allocated to an enterprise are decided by its export performancesof the proceeding year, the export prices, its contributions to China'stotal exports of textile products and its qualification measured by theprovisions of rewards and penalties of the ticle 12 Allocation Approaches (1) Allocation of Basic Quota Allocation of basic quota is conductedevery yea r in two steps, the preliminary allocation in September of theproceeding year and the final allocation in March of the current year. ((1)) The preliminary allocation of basic quota a. Every year in September, quota is distributed preliminarily forthe followi ng year. Enterprises that have basic quotas and utilized up to60% during January to August will be allocated 80% of its basic quota. Theformula is: basic quantity x 80% = quantity of preliminary allocation for thefollowing ye ar b. Enterprises that actually used less than 60% of their basic quotawill get the preliminary quantity pro rata. The formula is: basic quantity x actual utilized percentage = quantity of preliminaryallocation for the following year ((2)) The final allocation of basic quota Under normal trade conditions, enterprises that utilized in theproceeding yea r 90% of their basic quota can obtain 100% of their sharefor the current year; If the utilization was less than 90% but the unusedquantity had been submitted before July 15 of the same year, they wouldobtain 100% of their basic quota as well. The formula is: basic quota of the proceeding year x 100% = basic quota of thecurrent year If the basic quota has not been used up in two consecutive years, theunused quantities would be deducted for the third year even it wassubmitted in time. If the submission was conducted in August and September, 25% of thesubmitted quantities would be deducted for the following year. The formulais: basic quota of the proceeding year-balance submitted x 25% = basicquota of the current year If submitted in October and November, 50% would be deducted and theformula is: basic quota of the proceeding year-balance submitted x 50% = basicquota of th e current year If submitted after 1st of December, whether submitted or not, 100%would be deducted. The formula is: basic quota of the proceeding year-balance submitted or not = basicquota of the current year In case the balance is not submitted in two consecutive years or thequota is wasted considerably, the enterprise will be punished to have itsquantities double deducted. (2) Allocation of the annual growth quota ((1)) The annual-growth quota quantities are allocated by MOFERT, inaggregate amounts to each local authorities and the departments underother Ministries and Commissions, in accordance with the contributions oftheir enterprises to China's total export of textile products. The ForeignTrade Commissions of the local governments recommend to MOFERT theallocation of this aggregate quantities. Upon MOFERT's approval, theallocated aggregate quantities shall be designated, together with thefinal allocation of basic quota, to the enterprise. Quota for thedepartments of other Ministries and Commissions are allocated directly tothem, together with the final allocation, according to their contributionsto total textile export. ((2)) Contribution to total textile export refers to the ratio, tothe nation's gross textile export value, of the total textile export valueof a province, autonomous region, municipality directly under the CentralGovernment, municipality with separate plannings and departments underother Ministries and Commissions. ((3)) The annual growth allocation formula: a. The nation's gross textile export value ------------------------------------------------------- annual growth quantities in terms of standardized quota = average value per standardized unit b. Total textile export value of province x x -------------------------------------------- quantity of annual growth = average value per standardized unit allocation to province x x (3) Allocation of quota under other flexibilities clauses This quota refers to the quantities available from the flexibilitiesclauses stipulated in the bilateral agreements (carry-over and categorytransfer), the deducted quantities as applying penalties and the submittedquantities from localities. ((1)) Allocation of carry-over and category transfer quantities: a. Part of th em will be distributed by MOFERT in the finalallocation to enterprises of outstanding performance according to theprovisions in Article 11, Chapter 3 of the Provisions. b. The rests will be allocated according to Article 14, Chapter 4 ofthe Provisions. ((2)) Penalized quota shall be first used to compensate theenterprises which have been affected from fully utilizing their e surplus, if there be any, will be allocated according to Article 17,Chapter 6 of the Provisions. ((3)) Submitted quota shall be handled in accordance with Article 14,Chapter 4 of the Provisions. (4) Quota Tendering ((1)) For the purpose of encouraging the export of higher qualitygarments, increasing economic benefit and offering more opportunities offair competition to qualified enterprises, certain amount of quotas shallbe arranged by MOFERT every year for open tender. ((2)) A Working Committee on Tenders (comprised by representativesfrom Foreign Trade Administration, MOFERT and China Chamber of Commercefor Import and Export of Textiles) takes charge of bidding processes. ((3)) Quota tendering shall follow the regulations formulated byMOFERT. Chapter 4 Quota Transfer and AdjustmentArticle 13 Quota Transfer (1) Export enterprises in same area may consult with each other totransfer their basic quotas. This transfer will become valid only after ithas been approved by the local authorities and filed with MOFERT andconfirmed with a Notice of Transfer. (2) Export enterprises in different areas may also consult with eachother to transfer their basic quotas. This transfer will become valid onlyafter it has been approved by the local authorities of the transferor andfiled with MOFERT and confirmed with a Notice of Transfer. (3) Quotas transferred out must be the basic portion of exportenterprises and shall not exceed 20% of the relevant categories. Otherwisethe over-exceeded quantities will be deducted in the next year. If acategory were involved to be transferred out for two consecutive years,quantities will be deducted accordingly in the third year. (4) Quota transfer can be validated only among the enterprises thathave the basic quotas. If quotas are to be transferred to exportenterprise of no basic quota but approved by the State to handle textileexport business and committed to hand over foreign exchange earnings, thistransfer shall be approved by the local authorities of the transferor andfiled with MOFERT and confirmed with a Notice of Transfer. (5) Transferees shall not re-transfer out the quotas that aretransferred ticle 14 Quota Adjustment (1) Quota adjustments among the export enterprises of same area canbe made possible by the local authorities depending on the quotautilizations of each enterprise. This adjustment will become valid onlyafter it has been approved by the local authorities of the transferor andfiled with MOFERT and confirmed with a Notice of Adjustment. Adjustments, to the enterprise which are approved by the State tohandle textile export business and committed to hand over foreign exchangeearnings but have no quotas shall be filed with and approved by MOFERT. (2) MOFERT will organize nationwide quota adjustments in the secondhalf of the year depending on the utilizations. ((1)) Source of quotas for adjustments are mainly from the unusedquotas returned from local authorities, and some of the quantities fromthe flexibilities clauses (i. e. carryover and category-transfer). ((2)) Quota adjustment shall be conducted according to the provisionsof Article 17, Chapter 6 of the Provisions. ((3)) Quota adjustment shall be made relatively concentrated andopenly. ((4)) Applications for adjustment shall be presented through localauthoritie s. MOFERT will not, in normal cases, accept applications fromexport enterprise. Chapter 5 Quota Calculation and StatisticsArticle 15 Quotas are calculated in terms of calendar ticle 16 Statistics of Export Licenses for Textile Products shall beimplemented in accordance with the Rules on Statistics and Monitoring ofExport Licenses for Textile Products to Restricted Countries promulgatedby MOFERT. Chapter 6 Rewards and PenaltiesArticle 17 The export enterprises that strictly follow the Provisions andeffectively use the quota up to 95% or more, will get certain rewards forone of the following qualifications. (1) Making a remarkable progress to export high-grade products. (2) Promoting the export of non-quota products. (3) Using more domestic-made fabrics than other ticle 18 Penalty will be applied to the following cases: (1) Wastage: The enterprises that do not return back the unused quotain accordance with the provisions of the Provisions will be penalized asstipulated by Article 12, Chapter 3. (2) Over-using: If an enterprise overuses quota, the overusedquantities will be deducted as much or in multiplicity; and if issuingauthorities over-issue export license, a notice of reprimand will becirculated nationwide and in serious cases, their issuing authorizationswill be suspended. (3) Low Prices: If an enterprise exports its products at over lowprices, certain amount of its next year's quotas for relevant categorywill be deducted. (4) Fraudulent Practices: If an enterprise applies for exportlicenses but does not actually export the goods, double quantities of thenext year's quotas will be deducted. (5) Illegal Transshipment: If an enterprise violates the rules oforigin made by importing countries by using the certificates of origin orlabels of the third country (region) to transship Chinese textile productsillegally to the countries which have restrictions on the products underbilateral textile agreements with China either the quantities involved orin multiplicity will be deducted from the quotas of the enterprises or thequotas of the regions where the enterprises are located, or the goods beconfiscated and a fine be imposed or legal penalty be imposed, alldepending on the seriousness of the cases. (6) Misses of Licences: If blank export licences are last due toadministration and therefore cause the unauthorized occupation of quota,the quantities involved will be double deducted from quota of the partiesconcerned (7) Falsifications: Anybody who alters the content of Export Licensewithout official permission or forges Export License, severer penaltiesshall be applied, including submission to judicial authorities forinvestigating the legal responsibilities. (8) The Chinese Customs can impose a fine on or confiscate the goodsfor export if they are handled in violation of the Provisions depending onthe seriousness of the ticle 19 The sources of the rewarding quota are the quantities from penaltiesand the quota offered by the Flexihilities Clauses. But the quantitiesfrom penalties shall be used as priority to compensate the enterprises whohave been affected from fully utilizing their ticle 20 The rewarded quota to the enterprises is not accounted as theiradditional basic level for the following years Chapter 7 Supplementary RulesArticle 21 All the works on quota administration shall strictly follow theprovisions of the Provisions to avoid any irregularities. Administrativeofficials in both MOFERT and local authorities shall accept ter investigation and verification, those who abuse their privileges toseek personal gains and violate the Provisions, disciplinary punishmentand even criminal penalty shall be imposed according to the nature of ticle 22 Enough specialized personnel shall be deployed and kept stable in alllocal authorities and ticle 23 Within the framework of the Provisions and taking into account thepractical situation in the areas, all the local authorities shall set upand file with MOFERT the detailed rules for implementing the ticle 24 The Provisions shall enter into force on January 1, 1993, and replacethe previous Provisions published on January 1, 1985. Note: In order to let the readers to understand it more easier, thereis a little different in the layout between Chinese and English, but thereis no change in the content of the Provisions.
